Your use of the Company website is subject to these terms and conditions. Please read them carefully as they affect your rights and liabilities under the law. By clicking "I accept" at the end of this screen and accessing the website at www.ecomiki4kids.com (the "Site") you are forming a contract and agreeing to the terms that appear below. 1 Use of the Site
1.1 The Site is provided to you, for you and your children's use, subject to these terms and conditions. By using the Site you agree to be bound by these terms and conditions. These terms and conditions apply:-
• When you register for the Site's free play.
• When you or your children use the Site as a paid member.
2 Changes
2.1 We may update these terms and conditions from time to time for legal or regulatory reasons or to allow the proper operation of the Site. We will tell you of any changes by the e-mail address you gave us on registration or by a suitable announcement on the Site. The changes will apply to the use of the Site after we have given you such notice. If you do not wish to accept the new terms and conditions you should not continue to use the Site. If you continue to use the Site after the date on which the change comes into effect, your continued use indicates your agreement to be bound by the new terms and conditions.
3 Registration
3.1 If you are under 14 please ask your parent or the person who looks after you to help you use the Site.
3.2 If you are over 14 you can use the Site but you will need your parents to help you join as a member.
3.3 To register as a member on the Site you must be over 18 years of age. If you are under 18 you need to get your parent's consent to register with the Site and pay the subscription.
3.4 You must ensure that the details provided by you on registration or at any time are correct and complete.
3.5 You must inform us immediately of any changes to the information that you provided when registering by updating your personal details in order that we can communicate with you effectively.
4 Password and security
4.1 When you register to use the Site you will be asked to create a password. In order to prevent fraud, you must keep this password confidential and must not share it with anyone, other than your parent or the person who looks after you. If you know or suspect that someone else knows your password you should notify us by contacting enquiries@ecomiki4kids.com immediately. You must not allow anyone else to use your password. If you do this may result in your membership being cancelled.
4.2 If the Company has reason to believe that there is likely to be a breach of security or misuse of the Site, we may require you to change your password or we may suspend your account.
5 Intellectual property
5.1 The content of the Site is protected by copyright, trade marks, database right and other intellectual property rights. You may retrieve and display the content of the Site on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Site without the Company's written permission.
6 Use by children
The Site is for children particularly between the ages of 3 and 9. You should supervise your children's access and use of the Site at all times. You should always use caution when reviewing personally identifiable information about yourself or your children through the Site.
If you are under the age of 16 you should obtain your parent's consent before sending any personal information to the Site. If you are under 14 you should not send any personal information without your parent's written consent so please ask your parent or legal guardian to send us an email saying that they consent to us collecting your information through the Site.
7 Your use of the Company Site
7.1 You may not use the Site for any of the following purposes:
7.1.1 Spreading any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material or otherwise breaching any laws;
7.1.2 communicating any material that encourages conduct that constitutes a criminal offence, or otherwise breaches any applicable laws, regulations or code of practice;
7.1.3 Interfering with any other person's use or enjoyment of the Site;
7.1.4 Making, sending or storing electronic copies of materials protected by copyright without the permission of the owner.
7.2 You will be responsible for our losses and costs resulting from your breach of clause 7.
7.3 If we receive any complaint about the use of the Site we shall investigate it and hold any user responsible for inappropriate behaviour.
8 Pricing
8.1 Membership is paid by monthly subscription and you can pay by your debit or credit card or by Paypal.
8.2 You can have a quarterly, six month or yearly subscription if you pay by Paypal.
8.3 We will charge your subscription monthly to the debit card or the credit card you supply to us on registration. A payment will be authorised immediately and collected within 3 working days.
8.4 Memberships are not refundable.
8.5 If you decide to cancel your membership you must tell us by sending an email via the contact form click here. If not we will continue to charge your debit or credit card on a monthly basis.
8.6 If you decide to cancel your membership part way through a month you will be charged for that full month's subscription.
8.7 When you cancel your membership it will expire at the end of the one month period you have bought.
8.8 We are committed to offering value for money. However reserve the right to increase our membership prices from time to time. We will send you a notice of increase in price by the email address you gave us on registration or by a suitable announcement on the Site. We will give you not less than 30 days notice of an increase in price.
9 Availability of the Company Site
9.1 Although we aim to offer you the best service possible, we make no promise that the services on the Site will meet your requirements. We cannot guarantee that the services will be fault-free or that your access to any content on the Site will be uninterrupted or error free. We do not warrant that the Site is virus free but should a virus occur we will attempt to remove it as soon as is reasonably practicable. If a fault occurs with the Site you should report it to enquires@ecomiki.com and we will attempt to correct the fault as soon as is reasonably practicable.
9.2 Your access to the Site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services to add to your enjoyment of the Site. We will attempt to restore the service with the minimum of delay.
10 The Company's right to suspend or cancel your registration.
10.1 We may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these terms and conditions.
10.2 You can cancel your registration at any time by informing us in writing at enquiries@Ecomiki4kids.com. If you do so, you must stop using the Site.
10.3 The suspension or cancellation of your registration and your right to use the Site shall not affect either your or our statutory rights or liabilities.
11 The Company's liability
11.1 The Site provides content from other Internet sites or resources and while the Company tries to ensure that material included on the Site is correct, reputable and of high quality, it does not make any warranties or guarantees in relation to that content. If the Company is informed of any inaccuracies in the material on the Site we will attempt to correct the inaccuracies as soon as is reasonably practicable.
11.2 If we are in breach of these terms and conditions, we will only be responsible for any losses that you suffer as a result to the extent that they are a foreseeable consequence to both of us at the time you use the Site. Our liability shall not in any event include business losses such as lost data, lost profits or business interruption.
11.3 This clause 11 shall not limit or affect our liability resulting from any products sold through the Site being found to be unsafe or if something we do negligently causes death or personal injury.
12 Third Party Websites
12.1 As a convenience to customers, the Site may, at times, include links to other websites or material which are beyond its control. The Company is not responsible for content on any site outside the Site. You access these external websites at your own risk.
13 Advertising and Sponsorship
13.1 Part of the Site may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Site complies with relevant laws and codes. We will not be responsible to you for any error or inaccuracy in advertising and sponsorship material.
14 Privacy Policy
14.1 We are committed to maintaining your privacy and the security of any personal information which we receive from you. We subscribe to the principles of the data protection legislation. If you register as a member you will be asked to provide basic personal information such as your first name and your email address. The information provided by you is not available for sale or use by third parties and will be used only for letting you know of changes to the Site.
14.2 If you wish us to disclose your personal information to third parties we will only do so if you consent by ticking the opt in consent when completing forms on this site.

15 Applicable Law
15.1 These terms and conditions will be subject to the laws of England and Wales. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so within the United Kingdom.
16 International Use
16.1 We make no promise that materials on the Site are appropriate or available for use in locations outside the United Kingdom, and accessing the Site from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.
17 Miscellaneous
17.1 You may not transfer any of your rights under these terms and conditions to any other person. We may transfer our rights under these terms and conditions to another business where we reasonably believe your rights will not be affected.
17.2 If you breach these terms and conditions and the Company chooses to ignore this, the Company will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the terms and conditions.
17.3 The Company shall not be responsible for any breach of these terms and conditions caused by circumstances beyond its reasonable control.
